Topics of study include property rights, title concepts, liens, contracts, mortages, deeds, and other property instruments. Students must complete this course and REA-101 to qualify as a candidate for the New Jersey Real Estate Salesperson’s Examination. ● Prerequisites: REA 101 Real Estate Law I, which must be taken as a prerequisite or may be taken as a corequisite. Completion of both are required to qualify for the New Jersey Real Estate licensing exam. ● Credits: 3 credits Supplemental Materials: To be provided by the professor during the semester either in hardcopy or via email. . Student Learning Outcomes: As a result of meeting the requirements in this course, students will be able to: Student Learning Outcome: Means of Assessment: 1.To provide the student with the ability to successfully qualify for and pass the New Jersey Real Estate Salesperson’s Exam. Students will take examinations during the course similar to those given by the New Jersey Real Estate commission. These exams will relate the subject matter which being addressed at that time. Issues and the practical application of principles. Standard: At least 80% of all students will receive an average grade of “70” or better on the exams. Exams will be reviewed with students and concepts reinforced. Homework assignments will be required specifically addressing this course learning outcome. 2. To prepare the student for the participation and understanding of the legal and ethical standards required to participate in the real estate market place. From contract to settlement. Students will take examinations and submit projects during the course which will require them to show an understanding of the transfer process. Students will be required to demonstrate their understanding with an emphasis being placed on legal and ethical concerns. 2 Standard: At least 80% of all students will receive an average grade of “70” or better on the projects. Course Content: Class Session # Material 1 (2.5 hours) Introduction to Real Estate Law Ch. 5 2 (2.5 hours) Discussion of real property rights and the differences between real and personal property and fixtures. Issues with property adjacent to water., Chs. 5 & 9) 3 (2.5 hours) Government police powers, public restructions and ownership along with private deed restrictions. Voluntary and involuntary transfers of real property. 4. (2.5 hours) Encumbrances, Estates in Real Property and Co-Ownership 5. (2.5 hours) Exam #1 Introduction to the conveyance process. 6. (2.5 hours) Valuations of real estate and taxation. Agency relationships in real estate transactions. 7. (2.5 hours) Introduction to Contracts. Landlord Tenants relationships and the NJ laws to protect tenants rights 8. (2.5 hours) Contingencies in Real Estate Contracts, the inspection process and Environmental Issues. Review for Exam#2 9. (2.5 hours) Exam #2. Discussion of the primary & secondary Mortgage Markets. 10. (2.5 hours) Financing options, the loan application and review process. Loan documentation and settlement. Review for Exam #3 11. (2.5 hours) Exam #3 12. (2.5 hours) Title searches, Settlement procedures, preparation of the Closing disclosure Statement, with adjustments fand prorations. 13. (2.5 hours) Title Insurance, transfer document types and preparation 14. (2.5 hours) Legal descriptions, affidavits, and title closing. Review for Exam #4 15. (2.5 hours) Exam #4 Course Texts and/or Other Study Materials: Essentials of New Jersey Real Estate, Lank & sobeck, Dearborn Press..Current Edition. Grading Policy: Evaluation and Assessment: There will be four unit exams during the semester. Each will count 20% of your grade. Tests are non-cumulative. Class participation is based on attending class, contributing to discussions, and completing the assignments in a timely manner. All Unit Examinations must be taken in order to receive a grade. Make-Up examinations must be taken prior to the next class meeting. The make-up exam may not be the same exam taken by your class. You are allowed only one make-up exam. Please be advised that no extra credit assignments will be given. (See grading scale below) GRADING SCALE 100-90 89.75-100 A 90-80 87.75-89.50 B+ 90-80 80-87.50 B 80-70 77.75-79.9 C+ 80-70 70-77.50 C 70-60 60-69.9 D Below 60 Below 60 F 5 Attendance Policy: Attendance is required: Pursuant to NJAC 11:5-2.2(s): To satisfactorily complete any pre-license course a student must receive a passing grade and attend at least 80 percent of the class session hours required for the course by NJAC 11:5-2.1 Attendance: Will be taken at each session and is subject to the rules of the college. Attendance at lectures is imperative to acquisition and understanding of the substantive material of the course. Habitual absence (considered more than two unexcused absences) and/or tardiness may result in loss of credit for the course. Students are instructed to notify the professor prior to absences, if known and are responsible for the materials from classes which are missed. Students are required to all examinations on the announced date or otherwise scheduled at the discretion of the instructor. All examinations must be completed for credit for the course Cell/Smart Phones: The use of cell/smart phones and other electronic devices is not permitted in class and all students must silence their cell phones prior to class session. Audio and video recording and photography is prohibited in class.
